IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA

SECOND APPELLATE DISTRICT

DIVISION SIX

THE PEOPLE,

Plaintiff and Respondent,

v.

DAVID CHARLES GILLIAM,

Defendant and Appellant.

2d Crim. No. B182794

(Super. Ct. No. F358059)

(San Luis Obispo County)

David Charles Gilliam appeals a judgment following his guilty plea to grand theft and three counts of writing checks with insufficient funds. (Pen. Code, §§ 487, subd. (a) & 476A, subd. (a).) The trial court sentenced Gilliam to a prison term of two years and eight months. It also denied him presentence custody credits because he already was incarcerated in an unrelated matter. (Pen. Code, § 2900.5, subd. (b).)

We appointed counsel to represent Gilliam in this appeal. After counsel's examination of the record, he filed an opening brief raising no issues.

On August 30, 2005, we advised Gilliam that he had 30 days within which to personally submit any contentions or issues that he wished to raise on appeal. We have not received a response.

We have reviewed the entire record and are satisfied that Gilliam's attorney has fully complied with his responsibilities and that no arguable issue exists. (People v. Wende (1979) 25 Cal.3d 436, 441.)

The judgment is affirmed.

NOT TO BE PUBLISHED.

GILBERT, P.J.

We concur:
