IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA

SECOND APPELLATE DISTRICT

DIVISION SIX

THE PEOPLE,

Plaintiff and Respondent,

v.

MARK LYNN MORZE,

Defendant and Appellant.

2d Crim. No. B177527

(Super. Ct. No. 2003018740)

(Ventura County)

Mark Lynn Morze appeals from a judgment following his conviction by jury of driving under the influence (DUI) of alcohol with a prior DUI felony conviction, driving with a blood alcohol level of .08 percent or more, and driving with a suspended license. (Veh. Code, §§ 23550.5; 23152, subds. (a) & (b); 14601.2.) The trial court sentenced him to a prison term of two years.

We appointed counsel to represent Morze in this appeal. After reviewing the record, counsel filed an opening brief raising no issues and requesting this court to independently examine the record pursuant to People v. Wende (1979) 25 Cal.3d 436. We advised Morze that he had 30 days in which to submit a written brief or letter stating any contentions or arguments he wished us to consider. He filed a letter brief on June 29, 2005.

We have examined the entire record and considered the arguments in Morze's supplemental brief. We are satisfied that appellate counsel has fully complied with his responsibilities and that no arguable issues exist. (People v. Wende, supra, 25 Cal.3d at p. 441.)

The judgment is affirmed.

NOT TO BE PUBLISHED.
